Note on Husband: William Element

Will of William Element of Monken Hadley otherwise Monks Hadley in the County of Middlesex Gentleman, 6 Mar 1796. To daughter Kezia Smith five pounds for mourning; to Elizabeth Briars the wife of Samuel Briars of Totteridge in the County of Hertford fifty pounds; to William Garrow Esquire one of His Majesty’s Counsel and Francis Barroneau Esquire one guinea each for a ring as a token of my respect and acknowledgement for their trouble; rest of effects and personal estate to the said William Garrow and Francis Barroneau and my dear wife Elizabeth Element, execs, on trust to permit wife to receive interest dividends and annual produce thereof for her own use for life and after her death on trust to pay to daughter Kezia Smith a yearly annuity of twenty pounds for her own separate use free and clear of and from the control power or claim of her present or any future husband with whom she may chance to intermarry; and on trust to pay the surplus of the interest dividends and annual produce of one thousand pounds three percent consolidated bank annuities towards the maintenance and education of my three grandchildren Elizabeth Smith Jane Smith and Margaret Smith during the life of my daughter Kezia Smith and after her decease to transfer to granddaughter Elizabeth Smith four hundred pounds (part of the above-mentioned one thousand pounds) for her use and benefit, to granddaughter Jane Smith three hundred pounds, to granddaughter Margaret Smith three hundred pounds in like manner; to wife my freehold copyhold and leasehold estate for life and after her decease I bequeath to granddaughter Elizabeth Smith my freehold dwelling house in which I now live and my freehold dwelling house and shop now in the occupation of William Baker also my two freehold cottages adjoining the last mentioned dwelling house and shop all of them in Monken Hadley and also my freehold house in Chipping Barnet called the Boars Head Inn now in the occupation of John Newlin to the use of Elizabeth Smith and her heirs forever; to Jane Smith after decease of wife my copyhold estate in South Mimms in the County of Middlesex in the occupation of Francis Knight Robert Hardy and James Willis; to Margaret Smith my leasehold estate in Monken Hadley; rest and residue of estates and effects of every kind to be equally divided among my three grandchildren share and share alike as soon as they attain the age of 21 years.

Codicil 12 May 1797: To wife Elizabeth Element the further sum of two hundred pounds three percent consolidated annuities purchased by me on 16 Aug 1796.

Will of Elizabeth Element of Hadley, Middlesex, widow, 8 Jan 1816. To daughter Elizabeth Briars of Totteridge in the County of Hertford fifty pounds of four percent consolidated bank annuities transferrable at the Bank of England; to great grandson William Element Attfield three hundred pounds like annuities; to great granddaughter Julia Attfield one hundred pounds like annuities; to great grandson Henry Rose Attfield one hundred pounds like annuities; these legacies to be paid to the great grandchildren when they attain the age of 21 years; the interest and dividends of the said legacies shall be applicable towards the maintenance and education of my said great grandchildren during their respective minorities; to James Quilter of Hadley Esq and Robert Bishop of the same place carpenter execs two guineas each for their trouble; all wearing apparel and rest of personal estate and effects to my granddaughter Elizabeth wife of William Pool Attfield of Hadley surveyor.

Codicil 28 Oct 1816: To be buried in the same grave with my late husband and to have a flat stone ledger laid over the same specifying the time of our respective deaths and ages.
