Note on Husband: Arthur Fawkes

Will of Arthur Fawkes. I Arthur Fawkes being in possession of my reason do will and bequeath that my lawful Wife Mary Fawkes be provided for out of all my property whatsoever, that is my landed and personal property according to the wishes of my brother Marmaduke Fawkes and Thomas Berridge of Dunton in the County of Leicester. I do moreover will and desire that the aforesaid Marmaduke Fawkes & Thomas Berridge be my Executors for all my property aforesaid, and that they do divide my said property after such provision as they shall award to the said Mary Fawkes be subtracted, into seven equal portions, two portions of which I bequeath to my eldest son John Fawkes, and the other several portions I bequeath to such of my other sons Arthur, William and Thomas, George and James, and I do further bequeath that in the event of any of my sons aforesaid dying while in their minority that such portion as should have belonged to such son be equally divided among the other surviving sons. In Witness whereof I have hereunto set my hand this thirtieth day of July in the year of our Lord one thousand eight hundred and twenty five.

14th January 1826. Let a Probate be made to Marmaduke Fawkes of Claybrook Mill in the Parish of Claybrook in the County of Leicester Miller and Baker and Thomas Berridge of Dunton Bassett in the said County Farmer and Grazier the said Executors named in the Will of the deceased who died on the 30th day of July last, they having been first duly sworn as well to the faithful execution of the Will as that the Testator’s Goods Chattels and Credits as they were at his death without deducting anything on account of debts due and owing by him therefrom do not amount in value to the sum of Three hundred pounds.
