The Will of James HAMMOND the Elder made on the 11th May 1772 James HAMMOND the Elder died 27th May 1772

In the name of God Amen I James HAMMOND the elder of Windlesham in the county of Surrey yeoman considering the uncertainty of this mortal life do publish and declare this to be my last will and testament in the manner following first I give and bequeath unto my daughter Elizabeth the wife of John ELLIS one hundred pounds of lawful money of Great Britain to be payable in one month after my decease also I give to my daughter Ann the wife of John MEARS the annual sum of six pounds a year to be paid unto her by equal quarterly payments during her natural life and not to her husband and her receipt and hers only shall be a discharge for the same and from and after her decease I will and order that the said six pounds a year shall be annually laid out and bestowed on the maintenance education and bringing up my two grandchildren Sarah and James MEARS at the discretion of my son James HAMMOND his heirs and assigns until they shall severally attain to their age of twenty one years and when my said grand daughter Sarah shall attain to her said age of twenty one years I give her the sum of one hundred pounds of lawful money and then my grandson James MEARS aforesaid shall be paid two pounds a year until he shall attain his said age of twenty one years at which time I give him the sum of fifty pound of like lawful money and in case he die before the same become payable and leave no lawful issue I give the said fifty pounds unto his brother John MEARS and in case my said grand daughter shall happen to die without lawful issue before ??? shall become payable then I give the said one hundred pounds which she was to have as I have herein before ordered unto James and John her two brothers to be equally divided between them and for the payment of all the aforesaid legacies and annuities I charge all that my freehold estate which I heretofore purchased of Henry WAPSHOTT situate lying and being in the said parish of Windlesham in the county of Surrey aforesaid I also give to my daughter MEARS the bedstead and furniture belonging to the same which she lyeth on and the old bed that lyeth under me together with one blanket and coverlid I give devise and bequeath unto my son James HAMMOND all my whole estate both real and personal goods and chattels whatsoever and whatsoever but subject nevertheless to pay the said annuities and legacies above charged on the same together with my just debts and I do hereby appoint my said son James HAMMOND full and sole executor of this my last will and testament hereby revoking all former wills by me heretofore made and I do hereby order that my said daughter Ann shall not be accountable for her or her children while she is with me on account of their maintenance in witness whereof I have hereunto set my hand and seal this eleventh day of May in the year of our lord one thousand seven hundred and seventy and two--James HAMMOND

This will was proved at London the Twenty seventh day of August in the year of our Lord our savour one thousand seven hundred and seventy two before the worshipful Francis SIMPSON doctor of laws and surrogate of the right worshipful George HAY also doctor of laws master keeper of commissary of the prerogative court of Canterbury lawfully constituted by the oath of James HAMMOND the son and sole executor named in the said will to whom administration was granted of all and singular the goods chattels and credits of the said deceased he having first sworn duly to administrate.
