Will of Thomas Capon of Dennington, Suffolk, farmer, 26 Jun 1854. Jephta Smith of Laxfield farmer, my brother George Capon, my eldest son Thomas Elvin Capon and Thomas Crisp of Chillesford Lodge Suffolk farmer execs.; to John Claxton and Betsy Claxton children of my deceased sister Lydia Claxton £50 each at 21 or to be applied for the children’s benefit or advancement during their minorities if execs think proper; to my wife Emily Capon £100; execs to sell and dispose of all my freehold copyhold and leasehold messuages farms cottages lands etc (except any farm or farms which may be in my occupation at the time of my decease as tenant at rack rent), and I empower my execs to carry on the business of any farm or farms which may belong to me or be in my occupation as tenant at the time of my decease for as long as they shall think proper and with the further power to give up and relinquish to any of my children any of such last mentioned farms, such child or children paying the money valuation upon taking the farm and accounting for the amount of such valuation as part of their shares in my residuary estate; execs shall stand possessed of the monies to arise from sales as aforesaid from the rents and profits of the said real and leasehold estates until sale thereof and from the profits of the farming business and all monies that I shall die possessed of or entitled to, on trust to pay to my wife Emily an annuity of £150 for life; after decease of my wife the residue to be invested on trust for my children who shall attain the age of 21 and their issue; I declare that I have already advanced to my said son Thomas Elvin Capon the sum of £2,000 but without any interest thereon; my execs to be considered trustees of my real and personal estate [rest of will contains detailed provisions for the management and trusteeship of the estate and the various legacies].
