Note on Husband: John South
Will of John South of Ramsey in the County of Essex Farmer, 5 Aug 1856. I nominate Edward Cooper of Great Oakley Essex Farmer and William Brooks of Mistley Essex Merchant executors and trustees of this will. And whereas I sometime since held and occupied two farms called Foulton Hall and Mill Farm in the Parish of Ramsey as tenant to Walter Garland Esquire and Mr. Edward Cooper under two leases both of which expire at Michaelmas 1862, and whereas by an arrangement betwixt myself and my son John South the Younger Mill Farm has been occupied by my said son and the stock and crops thereon are his own property, and I have myself occupied the farm called Foulton Hall the stock and crops upon which are my own property; and whereas by another arrangement between me and my son it has been mutually agreed that my son shall take upon himself the occupation of the farm called Foulton Hall for his own use and that I shall take the farm called Mill Farm as my own occupation on the terms that a valuation should be made of all the said stock crop and effects on the two farms and that my said son should pay to me the amount of the difference in value between the two farms according to a valuation to be made by Mr. John Green Fenn of Ardleigh Hall Land Valuer; and whereas the said difference amounts at the present time to £2228 12s. 6d. upon a computation of wheat at £15 per load and my son has accordingly given me his bond for that amount payable on 29 September 1862 being the period of the expiration of the said lease with interest in the meantime at the rate of £4 percent per annum subject to the said amount being altered in the price of wheat according to the averages taken in the usual way should alter between Michaelmas day and Christmas day next ensuing; now I ratify and confirm the said arrangement with my said son John and give and bequeath the said bond and all other residue of my personal estate (except the household furniture stock and crop on Mill Farm which I have hereinafter otherwise disposed on) to my execs upon trust for the purposes hereinafter declared: to divide the same into seven equal parts or shares and to pay one seventh part to my wife Sarah South for her own use; one seventh to my son John South; one seventh to my daughter Anna the wife of the Reverend Edwin Fice of Tewkesbury Gloucestershire; one seventh to my daughter Elizabeth the wife of Leonard Roach of Port Adelaide South Australia; one seventh to my daughter Maria South; to divide one seventh amongst the children of my step daughter Sarah now the wife of Charles Howard, namely Charles Edward, John, Samuel Isaac and Walter in equal shares; to divide the remaining seventh between the two children of my deceased daughter Clementina late the wife of George Blumer of Hartlepool in the County of Durham; all monies which I have advanced to my son John to the said Charles Howard George Blumer and Leonard Roach or to any of my children or grandchildren and which advanced appear in my ledger shall be taken in part satisfaction of their shares in the residuary monies, it being my wish that each of my children should have an equal share of my property; I give and bequeath the household furniture brewing utensils and effects and all stock on Mill Farm at the time of my decease to my execs in trust to carry on my farming business on the said farm until such lease expires or at the option of my said wife if they can procure a further lease thereof until her death, and I give full power to them to cultivate improve and manage the farm in such manner as they shall think fit, and it is my wish as desire that my said wife shall aid and assist my execs in carrying on the business of Mill Farm, and the messuage on the said farm shall be kept for the purposes of a residence for my said wife, and the profits of the said business to be received by my said wife for her own use and disposal; if she sells Mill Farm at the expiration of the lease it is my wish that all the stock and crops be converted into money and divided into seven equal parts and be disposed or between my wife children and grandchildren as above; if she continues the occupation of Mill Farm obtaining another lease then I direct the conversion into money of the stock and crops be deferred until my wife shall quit the farm or depart this life, after which they shall be converted into money and divided into six equal parts and be disposed or between my children and grandchildren as above.
Codicil, 5 Aug 1856: I appoint Edward Cooper the Younger, son of the before named Edward Cooper, to act jointly as executor.
