Individual Note

Last Will and Testament of Mary Giles of Chertsey in the County of Surrey Spinster

To my servant Elizabeth Janaway all my freehold messuage or dwellinghouse (together with all the fixtures therein) in Guildford Street Chertsey and now in the occupation of George Tice together with the yard garden outbuildings and all and singular the rights members and appurtenances thereto belonging save and except a certain shed adjoining the dwellinghouse and situate between the same and the house now in my own occupation and together also with a right of way or passage into and through the said shed to and for the said Elizabeth Janaway her heirs and assigns and her and their servants and others at all reasonable times in the day time to carry and convey coals wood and other kinds of fuel and ashes to and from the said house now occupied by the said George Tice

To John Collins and Ann his wife all my freehold messuage or dwellinghouse in Guildford Street and now in my own occupation together with the yard garden outbuildings and all and singular the rights members and appurtenances thereto belonging and together with the said shed heretofore mentioned adjoining the said dwellinghouse now in the occupation of George Tice to hold for the term of their natural lives and the life of the survivor of them

After the decease of such survivor I give the same to Elizabeth Parkinson (formerly Elizabeth Kenworthy) wife of Thomas Parkinson residing at either Mitcham or Merton in the said County of Surrey to have and to hold for her natural life

After her decease I give the same to _____ Kenworthy and _____ Kenworthy (the two sons of Frances Kenworthy the late sister of the said Elizabeth Parkinson their heirs and assigns for ever as tenants in common and not as joint tenants

To Henrietta Thwaites of Stoke near Guildford widow of _____ Thwaites late of Clerkenwell in the County of Middlesex clock maker the annual rent or sum of six pounds for the term of her natural life payable out of the said last mentioned messuage or dwellinghouse and in case it shall be unpaid for twenty one days it shall be lawful for the said Henrietta Thwaites to enter and distrain for such yearly rent or sum

To William Henry Kempster formerly of Kingston in the said County of Surrey but now of _____ in the City of London gentleman all my freehold land at Knaphill in the Parish of Woking and now in the occupation of William [Antsebrook] and all my copyhold land at Sutton in the said Parish of Woking now in the occupation of Mr Lee and all other land at Knaphill and Sutton whether freehold copyhold or leasehold to hold the same to the use of the said William Henry Kempster his heirs and assigns for ever

To Thomas Webb of Whitechapel London blacksmith and John Webb of Brighton in the County of Sussex painter all those my four freehold houses in London Street Chertsey now or late in the occupation of Thomas Blake Sarah Webb widow William Cutler and Martin widow to hold the same to the use of the said Thomas Webb and John Webb their heirs and assigns for ever as tenants in common and not as joint tenants

To Elizabeth Longhurst widow of James Longhurst late of Thorpe in the said County of Surrey smith all that my copyhold messuage or dwellinghouse at Line Green in the Parish of Chertsey and now in the occupation of _____ Tilley or his undertenants and all and singular the rights members and appurtenances thereto belonging to hold the same to the use of the said Elizabeth Longhurst her heirs and assigns for ever

To Henry Roake of Addlestone in the Parish of Chertsey in the said County of Surrey gentleman Benjamin Tice of Chertsey ironmonger and William Edmeads of the same place gentleman and their heirs all my freehold piece or parcel of land called Turkers Mead situate in the Parish of Chertsey and containing about four acres part in the occupation of George Harcourt and the other part in my own occupation together with all the rights ways and appurtenances thereunto belonging to have and to hold the same unto the said Henry Roake Benjamin Tice William Edmeads their heirs and assigns during the natural life of Mary Anne Collard the wife of Valentine Collard of Teddington in the County of Middlesex esquire on trust to pay and apply the rents issues and profits thereof for the sole use and benefit of the said Mary Anne Collard during her life

After her decease I give the said piece or parcel of land called Turkers Mead to the said William Henry Kempster his heirs and assigns for ever

To the said Benjamin Tice all that piece or parcel of freehold meadow land containing about one acre and a half and known as Ford Water Brook in Eastworth Lane in the Parish of Chertsey together with all the rights ways members and appurtenances to the same belonging or in any wise appertaining to hold the same to the use of the said Benjamin Tice his heirs and assigns for ever

To the said Henry Roake Benjamin Tice and William Edmeads all my freehold messuage or tenement in Guildford Street Chertsey called Guildford Street Cottage with the outbuildings yards gardens and appurtenances to the same belonging and now in the tenure or occupation of George Harcourt and also all my freehold messuage or tenement with the appurtenances thereunto belonging near the sign of the Bell in Chertsey and now in the occupation of widow Knight to hold the same to the use of the said Henry Roake Benjamin Tice and William Edmeads their heirs and assigns on trust that they shall with all convenient speed sell and dispose of the said messuages tenements and premises either together or in lots by public auction or private contract for the best prices that can be had and shall stand possessed of and interested in the money arising from the sale as part of my personal estate and apply the same accordingly

I give and bequeath to my Executors the sum of eight hundred pounds three pounds per cent consolidated bank annuities on trust to transfer the same into the names of the Minister and Churchwardens for the time being of the Parish of Chertsey in the books of the Governor and Company of the Bank of England and if I should not have so much of the said stock or fund standing in my name at the time of my decease then I direct my Executors to purchase so much three pounds per cent consolidated bank annuities as shall be necessary to make up the said sum of eight hundred pounds three pounds per cent consolidated bank annuities with and out of my personal estate (but not out of my real estate)

I direct that the said Minister and Churchwardens and their successors shall stand possessed of and interested in the said sum of eight hundred pounds three pounds per cent consolidated bank annuities and the interest and dividends thereof on trust that they shall annually lay out and expend the sum of twenty one pounds in the purchase of Bread to be distributed among the poor of the said Parish on St Thomas’s Day in each and every year for ever and on trust that they shall pay the sum of two pounds to be divided equally between the said Minister and Churchwardens in proportion to their number for their individual care and trouble in providing and distributing the said Bread and on further trust to pay and apply the remaining one pound of the said interest towards keeping in repair the Tablet now set up in the parish church of Chertsey to the memory of my family and also the Tablet to be set up in the parish church of Chertsey as hereinafter mentioned and the family vault in the yard of the said church belonging to my family and in which I desire my remains to be interred

I desire that a Marble Tablet with an Inscription thereon of the bequest of the said sum of eight hundred pounds and the trusts and purposes of the same may be erected in the said parish church of Chertsey by my Executors

I give and bequeath to my Executors the sum of three thousand three hundred and thirty three pounds six shillings and eight pence three pounds per cent consolidated bank annuities on trust that they pay the interest thereof to the said Elizabeth Janaway during her natural life for her own sole and separate use and benefit and after her decease to pay transfer and assign the said sum of three thousand three hundred and thirty three pounds six shillings and eight pence three pounds per cent consolidated bank annuities equally between Daniel Dee of Walton on Thames Stephen Dee of _____ near London Amelia Burt of Chertsey widow William Atfield of Weybridge Richard Atfield and Jane Ellis of Chertsey Mary Evans and Sophia Mansfield of London Susan Clark now or late of Brentford in the County of Middlesex and Sarah Spong of _____ near London and their assigns as tenants in common

I give and bequeath to my Executors the sum of four hundred pounds three pounds per cent consolidated bank annuities and the interest dividends and annual produce thereof on trust during the natural life of Sarah Reynolds widow of John Reynolds of Chertsey to pay the said interest of the said sum of four hundred pounds three pounds per cent consolidated bank annuities to the said Sarah Reynolds for her own sole and separate use and benefit and after her decease to pay transfer and assign the said principal sum of four hundred pounds three pounds per cent consolidated bank annuities unto and equally between Frederick Giles Bloxam of Sunbury and Bob Blake of _____ near London physician as tenants in common

I give and bequeath the following legacies (that is to say)

It is my wish and desire and I do hereby accordingly direct that all my tenants shall be excused from payment of rent and shall remain rent free for the period of one year next after my decease

It is my wish and desire and I do also direct that Elizabeth Janaway shall if she thinks fit have the possession use and occupation of the house wherein I now reside and the use care and custody of all the fixtures and furniture therein for the period of twelve calendar months after my decease without paying any rent for the same and that my Trustees and Executors shall be at liberty to use the said house during the said period for the purpose of meeting and transacting any business relating to this my will or the trusts thereof and I direct that all taxes and charges affecting the said house and such use and occupation as aforesaid during the said period of twelve calendar months shall be paid by my Executors out of my personal estate

I give and bequeath to my Executors all the grates stoves fenders and fire irons in the House now occupied by me and also the Carpet rug side board and Chimney Glass in the best Parlour and the two Coppers in the Back Kitchen upon trust for the use and benefit of the person or persons who for the time may be entitled to the said house under this my will

To the said Elizabeth Janaway all my furniture in the Kitchen Wash house Store room and Cellar of the House in which I now reside (except the Clock in the Kitchen) and also all the furniture in my Bed Room (except the Iron Chest and the Articles hereby otherwise disposed of) and two Mahogany Round tables in the Little Parlour and six Mahogany Chairs and the drawers in the front left hand Bed Room also the glass over the Chimney Piece in the little Parlour and a large glass pot with two handles the family Bible and all the Clothes wearing apparel and linen belonging to myself and my late Sister (not otherwise disposed of) for her sole use and benefit

To the said William Henry Kempster a Silver Cup Six Silver Tea Spoons marked S a pair of Sugar Tongs a Punch Ladle my Mourning ring and the Beaded Cloth laid on Queen Ann’s Dressing Table when she died

To the said Elizabeth Longhurst the [Silver Hole] Dressing Table and small glass in the right hand front Bed Room and the Clock in the Kitchen

To the said Frances Coombes the Bell Pulls in my best Parlour

To the said Nathan Negus two Silver Table Spoons

To the said Eliza Rice two Silver Table Spoons

To the said Mary Lawrence a Mahogany Chair with slight convenience in it a Sofa Bedstead and two Silver Table Spoons

To the said Henry Roake a Map of Chertsey a Mahogany Flap Dining Table in the little parlour with Green Cloth to cover the same six mahogany chairs and two elbow chairs to match in the best Parlour with the empty Iron Chest in my Bed Room

To the said Benjamin Tice a Silver Cream Pot and Pepper Box and all my brother’s and father’s Silver Buckles and also my own and my sister’s

To the said Harriet Eleanor Harcourt six Silver Tea Spoons and Sugar Tongs marked M two Broaches and two stone rings

To the said George Wade Wetton the Wardrobe Bedstead Bed and furniture with the Blankets and Marsella Quilt and the Washing stand all in the front Bed room over the best parlour also the Dining Table and Pink Cloth two round tables and hand fire screen two stuffed Squirrels in cases plated Coffee Pot Tea Pot and Liquor Stand in the best parlour

I give devise and bequeath to the said Henry Roake Benjamin Tice and William Edmeads and the survivor of them and their heirs executors and administrators all the Rest Residue and Remainder of my Estate and effects of whatever nature and not by me specifically given devised or bequeathed upon trust to sell the same and convert the whole into money and after payment of all me debts legacies and charges and expenses attending the proving of this my will and the execution of the trusts thereof to pay and divide the residue thereof equally between the said Daniel Dee Stephen Dee Amelia Burt William Atfield Richard Atfield Jane Ellis Mary Evans Sophia Mansfield Susan Clark and Sarah Spong as tenants in common

In the event of any of the devisees or legatees (except devisees and annuitants for life) dying in my lifetime then the legacy or bequest herein given or devised shall be paid and transferred to his or her heirs executors or administrators for the use and benefit of the heirs or next of kin of such devisee or legatee so dying in my lifetime

I hereby declare that all devises legacies and bequests herein by me given to females whether covert or sole shall be for their own sole and separate use and benefit independent of their respective present or future husband or husbands and shall not be subject to the debts engagements or control of their said husbands and that notwithstanding any coverture all sums of money shall be paid to them respectively and their receipts for the same shall be good and effectual discharges to my said Executors and Trustees

In case my personal estate not herein specifically bequeathed shall not be sufficient to pay my just debts funeral and testamentary expenses and the legacies herein given excepting the said legacy of eight hundred pounds three pounds per cent consolidated bank annuities which I direct to be paid out of my personal estate only) then I direct such deficiency to be made good out of the monies arising from the sales of my real estates not specifically bequeathed

And in the event of there not being a sufficient amount of three pounds per cent consolidated or reduced bank annuities standing in my name at my decease to pay the whole of the stock legacies herein before given that my Executors and Trustees shall purchase such an amount of the said stocks as will be sufficient to satisfy the said legacies and I declare that the receipts of my said Executors and Trustees for any sums of money payable by virtue of any of the trusts herein contained shall be a good and effectual discharge to any person paying the same and he shall not be required or entitled to enquire into the application of the same

In case the said Henry Roake Benjamin Tice and William Edmeads or any of them or any future Trustee shall happen to die or be desirous of being discharged from or refuse decline or become incapable to act in the trusts hereby in them reposed before the trusts are fully performed or discharged then it shall be lawful for the surviving or continuing Trustees to nominate substitute and appoint any other person or persons in their room or stead

I hereby declare that the Executors and Trustees for the time being of this my will shall be charged and chargeable for only so much money as they shall respectively actually receive by virtue of the trusts of this my will and any one or more of them shall not be answerable or accountable for the others of them nor for the receipts neglects or faults of the others but each of them for his own acts receipts neglects or faults only nor shall any of them be answerable or accountable for any Banker Broker or other persons with whom any parts of the said monies may be lodged or deposited for safe custody or otherwise nor for any misfortune loss or damage which may happen in any part of the trusts hereof unless the same shall happen by their own wilful neglects or faults and also that the said Executors and Trustees may by and out of the monies which shall come to their respective hands by virtue of this my will pay retain and reimburse himself and themselves respectively for all losses damages and expenses which they may incur on account of any of the trusts herein contained

I nominate constitute and appoint my said Trustees the said Henry Roake of Addlestone in the Parish of Chertsey aforesaid Benjamin Tice of Chertsey ironmonger and William Edmeads of Chertsey aforesaid gentleman Executors of this my last Will and Testament and I hereby revoke and make void all former wills codicils and testamentary dispositions by me at any time herebefore made

In witness whereof I the said Mary Giles the Testatrix have to the first thirteen sheets of paper set my hand and to this fourteenth and last sheet my hand and seal this eleventh day of April in the year of our Lord one thousand eight hundred and thirty nine --- M Giles --- Signed sealed and declared by the said Testatrix Mary Giles as and for her last Will and Testament the same having been previously read over and explained to her in the presence of us who in her presence and in the presence of each other have hereunto subscribed our names as witnesses --- William Pidcock A M Clerk Curate of Chertsey --- B E Luttly Solicitor Wandsworth --- Henry Batt Clerk to Mr Luttly

 

A Codicil to the last Will and Testament of me Mary Giles of Chertsey in the County of Surrey Spinster bearing date the eleventh day of April last

To Benjamin Tice one hundred pounds sterling in addition to the four hundred pounds three pounds per cent consolidated bank annuities given to him by my said will

To Henry Roake Benjamin Tice and William Edmeads the Trustees the sum of three thousand pounds sterling upon trust that they invest the same in some or one of the Government stocks or funds of Great Britain and shall stand and be possessed of and interested in the stocks or funds to be so purchased and the interest dividends and annual produce thereof upon trust that they shall thereout pay all the reasonable costs charges and expenses insurred in the execution of the trusts hereby created an after payment thereof they shall pay and distribute the residue of such interest dividends and annual produce yearly for ever among so many of the poor people of and resident in the Parish of Chertsey in such sums at such times and in such manner as they shall think fit

I declare this present writing to be a Codicil to my said will and that the same shall be taken as part thereof and I confirm my said will in every particular thereof that is not hereby altered or revoked

Proved at London with a Codicil 29th January 1842 before the Worshipful Frederic Thomas Pratt Doctor of Laws and Surrogate by the Oaths of Henry Roake Benjamin Tice and William Edmead (in the Will written Edmeads) the Executors to who Administration was granted having been first duly sworn to Administer.
